INTRODUCTION

The access to the IdPost website is regulated by these terms of service and is subject to the laws and regulations. The terms of service regulate the methods, terms of delivery and use of all services currently provided by IdPost S.r.l. with registered office in Cagliari, at Via M. Malpighi n. 4, ZIP code 090126 VAT number 03702470927, Fax 0703495131, PEC idpostsrl@legalmail.it. The acceptance of these terms and conditions is a necessary for the use of the services offered by IdPost Srl. Accepting of these conditions of service, the Customer declares to have read, to have fully understood and accepted all the present contractual clauses and undertakes, as of now, to review and accept any changes, additions and / or updates to these terms of service, which will be adopted by IdPost Srl and published on their website. The information on the site may contain technical or typographical errors. IdPost reserves the right to make changes, corrections and improvements to these information, products and programmes described by them at any time and without any further notice. Downloading, displaying and printing information from this site is only permitted for personal use. Any use for non-personal and/or commercial purposes without the written consent of IdPost S.R.L. is prohibited.

1. SUBJECT

These terms of service regulate the provision of the account activation service (hereinafter referred to as the "Service") provided by IdPost S.r.l. with headquarters based in Cagliari, at Via M. Malpighi n. 4, ZIP code 090126 VAT number 03702470927, Fax 0703495131, PEC idpostsrl@legalmail.it. (hereinafter referred to as IdPost). IdPost provides a basic service free of charge for accounts activated by private and/or business users, an intermediate service, for business users (fee-based) and a profile reserved for affiliated companies with IdPost (fee-based). In addition to activating a personal customer account to connect to servers managed by IdPost, the service consists of the ability to store invoices, messages, and documents received from customers. To access your account, the customer must complete the registration form, stating their personal details, providing the tax code data along with other personal data required by the system. Once registration is complete, IdPost will send an email to the address provided by the Customer with which the account activation will be confirmed. The available space on the activated account will be different and functional according to the profile chosen by the customer. The service also provides an analysis of the amounts and consumption of the customer, referring only to attributable invoices to companies affiliated with IdPost. The customer will receive a notification and/or an alert from the system, through a reported trend and/or any anomalies that may occur in constancy of the contractual relationship between the parties. The service offered by IdPost allows the Customer to make payments, without IdPost being able to manage, display, modify, extrapolate or use the bank account details of the activated account. Rather, the Customer may keep a copy of the payments in the section dedicated to archiving.

2. DURATION OF THE SERVICE

IdPost provides the account activation service in "free subscription" mode for a period of 12 (twelve) months tacitly and it is automatically renewable upon expiry, for the same period of time and so from year to year, unless can be cancelled by the customer, sending an email or a letter at IdPost Srl to the registered office in Cagliari, at Via M. Malpighi n. 4, ZIP code 090126 VAT 03702470927, Fax 0703495131, PEC idpostsrl@legalmail.it, at least 30 (thirty) days before the natural expiry of the service.

3. OBLIGATIONS AND LIABILITY OF THE CUSTOMER

Once the IdPost service has been activated, the Username and Password will be created. After that, the customer will be responsible, to identify the password by modifying it, IdPost will no longer be responsible for keeping the old password that will be erased. The customer is obliged to create a password that is not easy to identify, according to the security procedures required by current legislation and prepared on the site www.idpostbox.com. The password can be changed by the Customer at any time and, for security reasons, the system of IdPost, will periodically send a notification to proceed with its modification. The customer is aware that any knowledge of the password by third parties would allow them to use the service and is therefore obliged to keep the password with the utmost confidentiality. The Customer will also be responsible for any damage caused by knowledge of the Password by third parties. The Customer also undertakes to communicate immediately to IdPost the possible theft, loss or a loss of confidentiality of the Password and remains, in any case, responsible for any use of the Service until it is communicated. The User also undertakes to communicate immediately to IdPost, any unauthorized use of their account or any other security breach of which it becomes aware. It is expressly excluded the possibility of transferring your account to third parties, free of charge or onerous, temporarily or permanently, without the written consent of IdPost. The possibility of profit from improper use of the service is also excluded.

4. IMPROPER USE OF SERVICES, SUSPENSION AND DISSOLUTION OF THE SERVICE

The Service of IdPost is for private, professional and/or commercial use. The service is provided for the exclusive use of the customer and in reference to the activated account. The customer is responsible for the use of the service taking the necessary precautions so that third parties do not use it in this way, and undertakes not to use it, so as to cause damage or disturbance to the operation of computer or telecommunications systems, telecommunications operators and other users in general and/or in a detrimental way to the rights of others, legal provisions, intellectual property rights of third parties, privacy rights, performing spamming, phishing or similar activities, or, in any case, in a way that is different from these terms and conditions of service. If the use of the service is found contrary to the current legislation, in the case of reporting by the public authority or third parties, IdPost may suspend, even partially and without notice, the service, notwithstanding the right of IdPost to invoke the termination of the service pursuant to art. 1456 c.c. and the experiment of every further remedy.

5. COMMUNICATIONS

All postal communications must be sent by the Customer to IdPost S.r.l. through the e-mail addresses assigned to the customer or prepared by IdPost for the service.

6. APPLICABLE LAW AND JURISDICTION

Although not expressly provided for in these conditions of service, the rules of the Civil Code and the current rules of law are referred to in this regard. If the customer is traceable, according to the current law, to the category of "consumer", the provisions of D. Lgs. 6 September 2005 N. 206 so-called "consumer Code", except for the provisions relating to contracts to distance and to contracts negotiated outside the commercial premises. Any dispute arising between the parties in connection with the execution, interpretation and termination of this act shall be given to the exclusive cognition of the Court of Cagliari, recognized and declared as the only competent Judge, without prejudice to cases where the customer is traceable, in accordance with the provisions of D. Lgs. 6 September 2005, No. 206 so-called "consumer Code", to the category of "consumers" in which case the jurisdiction will be the judge of the place of residence or domicile of the consumer if they are in the territory of the State.
